This Geek Lab Privacy Policy ("Privacy Policy") describes how we ("Geek Lab, together with our worldwide affiliates, "we" or "us") use information about each of our unregistered visitors and registered users (each, a "Visitor" or "User" (respectively), or "You"), in connection with your access to and use of Geek Lab's websites (including and any of its subdomains, the "Website"), applications ("Geek Lab Applications"), Mobile Applications ("Mobile Applications") and related services collectively, the "Services").
The purpose of this Privacy Policy is to provide you with a clear explanation of when, why and how we collect and use your personal information, as well as an explanation of your legal rights. This Privacy Policy does not provide the terms of any contract you have with us or any rights you may have under applicable data privacy laws.

Information for visitors and users
We collect two types of information about our visitors and users:
Non-identifying and non-identifying information relating to an unidentified Visitor or User, which may be available to us or collected automatically through the use of the Services ("Non-Personal Information"). Such Non-Personal Information does not allow us to identify the Visitor or User from whom it was collected.
Non-personal information collected by us consists primarily of technical and aggregated usage information, such as visitor and user navigation and clickstream activity, heat maps and page scrolling, non-identifiable information about the visitor's or user's device, operating system, Internet. browser, screen resolution, language and keyboard settings, Internet provider, referring/exit pages, date and time stamps, etc.
Personally identifiable information, i.e., information that identifies an individual or that with reasonable effort can lead to the identification of an individual or may be of a private or sensitive nature ("Personal Information").
Personal information collected by us consists primarily of contact details (e.g. email address or phone number), billing details (name, physical billing address, payment method and transaction details), which are only collected from users with paid services, information about a browsing session or usage (IP address, geographic location or unique device identifier), details relating to connected third party accounts (such as the email or username of a connected PayPal, Google or Facebook account), scanned identification documents provided to us (such as an ID card, driver's license, passport or official business registration document), correspondence (including correspondence entered or uploaded to our services) and any other personal information provided to us by visitors or users through their access to or use of the services. For the avoidance of doubt, any Non-Personal Information that is connected or linked to Personal Information (for example, to improve the Services we offer) is considered and treated as Personal Information, provided that there is such a connection or link.
User information about your users
We may also collect similar information relating to visitors and users of the Websites or Services from our Users ("Your Users"), solely for and on behalf of our Users.
Main methods we use
We collect information through your use of the Services. When you visit or use our Services, including when you browse the Website or a user's website, register a user account, edit your user website and upload information and content, or download and use any Geek Lab mobile application, we are aware of this. and may collect, compile and record such usage, sessions and related information, either independently or with the help of third party services.
We collect information that you voluntarily provide to us. For example, we collect Personal Information you provide to us when you register for our Services; when you sign in to our Services through third party services such as Facebook or Google; when you make purchases or register domain names; when you submit or upload such Personal Information when using any of our Services; or when you communicate with us directly through any communication channel (e.g., Geek Lab applications or emails.
Why do we collect this information?
We collect such personal and non-personal information for the following purposes:
To provide and operate the Services;
To further develop, customize and improve our Services, based on Visitors' and Users' common or personal preferences, experiences and difficulties;
So that our Users enjoy a permanent customer service and technical support;
Contact our Visitors and Users with general or personalized notifications and service-related promotional messages.
Facilitate, sponsor and offer certain contests, events and promotions, determine participant eligibility, monitor performance, contact winners and award prizes and benefits;
To create aggregated statistical data and other aggregated or inferred non-personal information, which we or our business partners may use to provide and improve our respective services;
To improve data security and fraud prevention capabilities;
To comply with applicable laws and regulations.
We will only use your personal information for the purposes set out below:
our use of your personal information is necessary to perform a contract or take steps to enter into a contract with you (for example, to provide you with a website builder, to provide you with our customer and technical support) or,
our use of your personal information is necessary to comply with a legal obligation or relevant regulation that we have or relevant legislation to which we are subject, or
our use of your personal information is necessary to satisfy the legitimate interests we have as a company (for example, to maintain and improve our services by identifying user trends and the effectiveness of Geek Lab's campaigns and identifying technical problems), provided that it is done at all times in a proportionate manner and that it respects your privacy rights.
Children under the age of 18 may not use our services. No one under the age of 18 may provide personal information to us through any of our services. We do not knowingly collect personal information from persons under the age of 18. Parents and guardians must supervise their children's activities at all times.
Where do we store your information?
Personal information about visitors, users and Geek Lab users may be stored in our data centers. We may use other jurisdictions as necessary for the proper provision of our Services and/or as required by law.
User information about your users
Geek Lab may collect, store and process certain personal and non-personal user information from its users ("user information from its users"), solely on behalf of and at the direction of our users. For example, each of our users may import their email contacts from third party services such as Gmail, or collect and manage contacts through their user website. Such contacts are then stored by Geek Lab, on behalf of the User.
For such purposes, Geek Lab serves and shall be considered a "Data Processor" and not the "Controller" of such Users' User Information. Users who control and operate such User Websites shall be considered the "Controllers" of such User Information of their Users and are responsible for complying with all laws and regulations that may apply to the collection and control of such User Information of such Users, including all privacy and data protection laws of all jurisdictions concerned.
Subject to applicable law, Geek Lab will process user information in accordance with the Data Processing Agreement found here.
You are responsible for the security, integrity and authorized use of your Users' Personal Information and for obtaining the necessary consents and permissions and providing the appropriate processing notices necessary for the collection and use of such information.
Geek Lab cannot provide legal advice to Users or Users of its Users, however, it is recommended that all Users post and maintain clear and complete privacy policies on their User Websites, in accordance with applicable laws and regulations, and that all Users of its Users carefully read those policies and ensure that they accept them.
If you are a visitor, user or customer of any of our Users, please read the following: Geek Lab does not have a direct relationship with the individual Users of its Users whose Personal Information it processes. If you are a visitor, user or customer of any of our Users and would like to make a request or inquiry regarding your Personal Information, please contact such User(s) directly.
Sharing personal information with third parties
Geek Lab may share (or allow access to) your Personal Information with third parties only in the following ways and instances:

Geek Lab has partnered with a number of selected service providers whose services and solutions complement, facilitate and enhance our own. These include server and co-location hosting services, content delivery and communications networks (CDNs), data security and cyber services, payment processing and billing services, domain name registrars, fraud prevention and detection services, web analytics, email distribution and monitoring services, remote session access and recording services, performance measurement, data optimization and marketing services, content providers and our legal and financial advisors (collectively, "Third Party Services").
Such Third Party Services may receive or have access to the Personal Information of our Visitors or Users from their Users, in whole or in part, depending on each of their particular functions and purposes to facilitate and improve our services and business, and may Use it solely for such purposes.
Please be aware that while our Services may contain links to other websites or services, we are not responsible for the privacy practices of such other websites or services. We encourage you to be aware when you leave our website and to read the privacy statements of each and every website and service that you visit before providing them with your personal information. This Privacy Policy does not apply to such linked third-party websites and services.
Law enforcement, applications and legal obligations:
Where permitted by local data protection laws, Geek Lab may disclose or allow others to access your Personal Information in compliance with a lawful request, such as a subpoena, court proceeding, search warrant or court order, or in accordance with applicable laws, if we believe in good faith that the law requires us to do so, with or without notice.

Geek Lab may share your Personal Information with others if we believe in good faith that it will help protect the rights, property or personal safety of Geek Lab, any of our users, users of users or any member of the public, with or without notice.
Use of cookies and other tracking technologies
Geek Lab, together with its marketing, analytics and technology partners, uses certain tracking and tracking technologies (such as cookies, beacons, pixels, tags and scripts). Data retention
We may retain your Personal Information (as well as your Users' User Information) for as long as your user account is active, as set forth in this Privacy Policy or as necessary to provide you with our Services.
We may continue to retain such Personal Information, even after you deactivate your User Account or stop using any of the Services, as reasonably necessary to comply with our legal obligations, to resolve disputes about our Users or their Users, to prevent fraud and abuse, to enforce our agreements and/or to protect our legitimate interests.
We maintain a data retention policy that applies to information in our care. When your personal information is no longer needed, we will ensure that it is securely disposed of.

MONEY-BACK GUARANTEE
If you are dissatisfied with the Geek Lab. services subject to a service term commitment or subscription fee and which is your initial purchase of such service, you may notify us of cancellation for any reason within thirty (30) days after the date you first ordered or activated such Services (the "Refund" AND "Refund Period").
The Rebate only applies to the initial purchase of the Services, which is an upgrade to a website. The Rebate does not apply to additional purchases, upgrades, modifications or renewals of the Geek Lab Services.
If you reside in a jurisdiction that requires a longer Refund Period, we will of course be happy to comply with such requirements, in accordance with all applicable laws. If Geek Lab receives such notice within the Refund Period, it will refund you the amount it actually charged you for the Services, in the currency originally charged, and cancel them accordingly. Please note that the refund amount may differ from the amount you were charged due to changes in exchange rates and third party fees. Geek Lab will not be responsible for any differences caused by changes in exchange rates or fees charged by third parties.
After the refund period, the fees paid by you are non-refundable and non-cancelable. In addition, if we discover that a cancellation notice has been issued in bad faith or in an illegitimate attempt to avoid payment for Services actually received and enjoyed, we reserve the right to charge the User who sent such notice for Services actually received, to the extent permitted by law.
Please note: Some services purchased on or through Geek Lab may not be refundable. These include third party services such as domains, commercial tools and applications. Geek Lab will not refund amounts paid for non-refundable paid services, applications or third party services.
OF PAYMENTS AND REIMBURSEMENTS.
The customer will pay in advance all charges corresponding to the service contracted to Geek Lab. As well as pay in advance the subsequent charges for services on the day of expiration of the contracted term for the duration of your subscription.
Geek Lab offers customers with newly created accounts with the company a thirty (30) day money back guarantee period, the customer agrees that all payments made are final and irreversible, once this period has elapsed. After this period, Geek Lab cannot and will not order the funds to be returned to the customer in the event that the customer believes that the payment was made in error and has not requested a refund within the 30-day period.
The customer must notify Geek Lab of any change in his personal or financial data that would prevent the company from charging for the service contract.
The company may deny, temporarily suspend or eliminate the contracted service in the event that the customer fails to make the corresponding payments according to these terms of service.
The customer agrees that the terms of its service will automatically renew at the end of the contracted period unless Geek Lab has received a cancellation request following the procedure described in this document. Therefore, the customer agrees that any charge made for the renewal of the contracted period is appropriate and releases Geek Lab from any dispute over such charge.
Geek Lab guarantees that, although the prices and characteristics of the services may vary, such variation will not affect the price at which the same was contracted by the client unless the client has not renewed the service within the established term and the service is cancelled/suspended by Geek Lab or the service is cancelled voluntarily by the client.
Geek Lab will send the invoice for the renewal of services with monthly billing cycle 7 days before the expiration of the same, for customers with annual billing cycles and for the renewal of domains, the invoice will be sent 5 days before the expiration, also a payment reminder will be sent 2 days before the expiration.
In case the customer does not pay the service on time, Geek Lab will send up to 3 notifications for the customer to pay the outstanding invoice, in case the customer ignores the notifications Geek Lab will proceed to suspend the service 5 days after the due date, the account will be completely deleted from the system 15 days after the due date of the invoice.
Geek Lab will add a late payment charge (Late Payment Fee) in case the customer fails to make the corresponding payments, this charge may vary between 5% and 10% of the total invoice and will be added to the outstanding invoice if it is for more than or equal to 3 days; in case the service has been suspended, it will be reactivated only after the customer pays the outstanding invoice(s) and its respective late payment fee(s) (late payment fee) if any.
In the event that companies such as Google, Facebook, WhatsApp, Instagram establish a fee for services that are currently free, it will be passed on to the customer at no additional charge.
OF THE PROMOTIONS
All promotions offered by Geek Lab are recurring (unless otherwise stated), that is, when contracting a product with a promotional price, the customer will pay the same price for as long as the product remains active unless the customer had not renewed the product within the established terms and the service is canceled / suspended by Geek Lab or the service is canceled voluntarily by the customer. The promotion will be valid only while the service is active, if the service is suspended due to abuse or lack of payment the promotion with which it could have been contracted will be void.
TERM
This agreement will be in effect for the contracted term described in the customer's order (or otherwise 365 calendar days) and will be in effect from the time the service is requested from Geek Lab. The agreement will automatically renew at the end of the contracted term unless the customer notifies Geek Lab that he/she wishes to cancel the service by complying with the guidelines described in the "Cancellation of Service" section.
CANCELLATION OF SERVICE
Cancellation of the service by the customer:
If the client wishes to cancel any service contracted with Geek Lab, he/she must send a cancellation request at least 8 days in advance. This notification will only be valid once Geek Lab has confirmed its receipt by the customer.
The customer is free to request Geek Lab to cancel the service at any time. A link is provided within the Client Area in the product administration section to request cancellation of the service at any time.
Services other than web hosting plans, reseller hosting, streaming plans, virtual and dedicated servers, such as domain registration or purchase of SSL certificates, chat systems (Facebook, web, WhatsApp, etc.), mass mailing, customer service bots, cannot be cancelled. before the expiration of the term for which they were purchased because their renewal periods are annual.
In case of failure to comply with the notification procedure described above, the customer authorizes Geek Lab to renew the service and process all charges corresponding to the contracted service. This charge will not be refundable and the service will continue for the time charged.
In case the customer uses automatic payment subscriptions, he must cancel the subscription immediately after requesting the cancellation of the service; this cancellation of the subscription must be made by the customer from his account in the above mentioned payment services, failure to cancel the subscription will cause the automatic payment service to send the payment of the subscription on the date the subscription was created.
SERVICE CANCELLATION BY Geek Lab
Geek Lab, may cancel the service contracted by the customer at its own discretion and without prior notice to the customer in the following cases:
If the customer has not paid in advance for the contracted term of service
If the customer has committed any breach of the commitments made in the "Terms and Conditions of Service". In the case of services with Facebook, Instagram and/or WhatsApp if the customer has violated the "Terms of Service" of the aforementioned companies.
Geek Lab is not and will not be responsible for the integrity of any account data that is terminated, suspended or disconnected due to non-payment or violation of any rule set forth herein.
The account may be suspended / terminated in case of any failure of Geek Lab staff, this includes, but is not limited to verbal or written failures, any kind of racial or gender discrimination; our staff is at your service, but they are professionals in their field and deserve the same respect as the customer.
Accounts cancelled, suspended or disconnected for any infraction to the rules established in this contract will NOT be able to request a refund since by violating this contract they automatically lose all the guarantee offered by Geek Lab.
If the customer has not paid within 15 days after the billing is due, the data stored in the customer's account will be completely deleted from our Data Center.
USE OF ALLOCATED SPACE OR CONSUMPTION QUOTA
Geek Lab customers may not use our servers for the storage of files that are not related to the customer's website, if any customer's account violates this policy, the related content will be removed from the server, of course, Geek Lab will make every effort to contact the customer before deleting the files involved, however, this may happen without notice.
The web hosting and reseller hosting plans offered by Geek Lab cannot be used for sending mass mailings, the maximum amount of emails that an account can send will be negotiated with the client, all messages sent must be requested by the recipient and it is strictly forbidden to send any unwanted mail, also known as SPAM.
Chat Services (Web, Facebook, WhatsApp) as well as mass mailings and advertising in digital media are assigned a consumption quota, so if the customer exceeds the assigned quota, he/she must purchase more quota or wait until the following month for the monthly consumption quota to be restored.
SUSPENSION OF SERVICE
Geek Lab may deny, temporarily suspend or remove the contracted service in case the customer fails to make the corresponding payments according to these terms of service.
In case the service is suspended by Geek Lab, the company may display an informative web page mentioning this suspension within the web space contracted by the client or using the methods it deems convenient.
If the service was suspended by Geek Lab and the client does not cancel the payments 15 days after the due date, the company will be able to delete all the data from the server, as well as the assigned consumption quotas, and reuse the space and consumption quotas with other clients. Releasing Geek Lab from all responsibility for not having complied with the payments on the established date.
UPGRADE OR CHANGE OF PLAN / CONTRACTED SERVICE
Any change in the plan / service must be notified to Geek Lab at least 8 business days before the next payment date. This notification will only be valid once Geek Lab has confirmed its receipt to the customer.
This includes among others, shared web hosting services, dedicated / VPS services, reseller hosting services, domain registrations and SSL security certificates / technology platforms, chat systems, digital media advertising.
If the notification procedure described above is not complied with, the customer authorizes Geek Lab to renew the originally contracted service and to process all corresponding charges. This charge will be non-refundable and the service will continue unchanged for the time charged.

Late or missing reimbursements (if applicable)
If you have not yet received a refund, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially issued.
